Terms and Conditions of Service

This is a translation provided for convenience. In case of any discrepancy, the Spanish version prevails.

1. General

These General Terms of Contract govern access to and use of the website https://www.cotizacionweb.cl/ (hereinafter CW).

It is your decision to purchase our services; therefore, you must state that you agree to our "Terms and Conditions". By accepting this document, you warrant that:

  • You have read and fully accepted these terms of use together with the Privacy Policy.
  • You are of the age and have the capacity required to accept and be legally bound by this agreement.
  • If you act on behalf of a legal entity, you have the authority to enter into this agreement in that capacity and to bind it to these terms.

1.1 Our service

We offer a web platform that makes managing sales requests more efficient, because all product, service and customer information is centralized in the cloud. Cotización Web lets you issue unlimited quotes, edit them and clone them, and shows yearly and monthly statistics for all quotes with their corresponding statuses.

1.2 Platform features

  1. Access security: we use hash encryption to handle passwords and important credentials.
  2. Information security: the data managed by each customer is stored and protected independently (privacy).
  3. Support: we provide ongoing support by email or phone to deal with any problems or incidents.
  4. Availability: we run on high-security, high-performance servers so that the management system is available 24 hours a day, 7 days a week, as long as the customer has an internet connection.
  5. Training: we provide explanatory video tutorials for some modules of the system, so that our customers can make the most of every feature of the software and fully understand how it works. If the customer requires it, we are available to advise on their training.
  6. Updates: we are constantly updating and improving our platform, taking into account our customers' comments and feedback, as well as generating new ideas to improve the service and the user experience.

1.3 What must you do to access our services?

You must accept these terms and conditions without reservation. Otherwise, you may not use CW in any way.

2. Changes to the terms

Cotización Web may change the terms and conditions of service at any time by publishing an updated version on the website. If it is a substantial change, we will notify you 30 days in advance so that you can decide whether or not you wish to continue with us.

We may make changes to these Terms at any time and publish a revised version on our website. The revised version will take effect upon publication. If the change includes a substantial modification, we will give you 30 days' notice by posting an announcement on our website for your subsequent rejection or acceptance.

3. Payment

The Cotización Web service is prepaid ("pay and use"). You may pay monthly, every six months, yearly, or prepay for as many months as you need. Each account created will have a limit on the time it may remain inactive (unpaid).

Once our team receives proof of payment, your account access will be enabled so that you can use CW for the period selected and paid for, together with the issuance of the corresponding invoice; once the paid period of use ends, this process will be repeated, provided you wish to continue using our services.

If you wish to cancel the platform before the months already paid for have elapsed, CW will have no obligation to refund the amount paid. Cotización Web's prices are set out on its website, www.cotizacion-web.com/en/pricing/, where they may be updated.

4. Intellectual property

Our software and all material we make available on the website is the property of Cotización Web and is protected by copyright, industrial property and other applicable laws. It may only be used by you for the purposes described by CW.

The services are protected by copyright, trade secrets and other applicable intellectual property laws. CW reserves all other rights to the services. CW grants you a personal, limited, non-exclusive and non-transferable right and license to use its services, until you stop using CW and for as long as you meet the relevant payment obligations and the clauses of these terms and conditions.

You declare that you will not use, or allow a third party to use, the services or content in any way that violates any relevant law or regulation, or these terms and conditions. You also declare that:

  • You will not give a third party access to any part of the services.
  • You will not reproduce, modify, copy, sell, exchange or resell the services.
  • You will not publish the services through any file-sharing or application-hosting service.

5. Privacy policy and data protection

None of the data collected through our online channels is shared with third parties. See our Privacy Policy for information on how we collect and use information. The Privacy Policy is part of these Terms, so make sure you read it and thereby authorize the processing of your personal data.

6. User-generated content and responsibility

6.1 You are responsible for the nature of the content you publish, upload or store on Cotización Web. CW may monitor your content to verify the correct use of the service. If irregularities are found, CW will provide the help necessary for the customer to use the service optimally and correctly.

6.2 You are responsible for managing your password(s) for the services securely, and for contacting CW upon becoming aware that there is or has been unauthorized access to your account.

6.3 You are responsible for the loss of unrecoverable content. You must provide all necessary and appropriate warnings and information. CW is not responsible for the content or data you provide through the services.

6.4 You declare that you will not use, or allow a third party to use, the service to upload, publish, distribute, link to, reproduce or transmit the following, or similar:

  1. Illegal, fraudulent, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, harassing, offensive, inappropriate or objectionable information or communications of any kind, including conduct such as insulting others, or criminal activity or activity giving rise to civil liability under any law.
  2. Content that could impersonate another person or represent a false identity or qualifications, or that constitutes a breach of any individual's privacy.
  3. Investment opportunities, solicitations, chain letters, pyramid schemes, unsolicited commercial communication or spam without CW's written authorization.
  4. Harmful software or data such as viruses, trojans, worms or others; or any information, programs or content that does not legally belong to you without the permission of the owner of the copyright or intellectual property rights, in accordance with Law 17,336 (Chile).

7. Availability of information

Your information will be available on the CW platform for as long as your account remains active. Once your CW account is closed (the paid period ends), we will wait 90 days from the date your account expires (non-payment) before completely deleting the information related to your account.

You may make backups manually by downloading PDFs and/or exportable Excel files directly from the CW platform as often as you see fit and whenever you wish. You may also request the information uploaded to the system, and we will email you an SQL script with all the information CW holds that you have been using.

8. Communication

We will contact you by email to offer news and promotions. You may choose not to receive these communications and we will respect that decision; however, as required by law, we will send you some emails with relevant information (for example, new terms and conditions).

9. Governing law

This agreement shall be governed exclusively by the laws in force in the Republic of Chile. Any dispute or conflict relating to this instrument shall be submitted exclusively to the competent courts of the Republic of Chile.
